PIC Notification Obligation for 40 New Substances

As of March 1, 2025, European exporters are now required to notify a larger number of substances. In fact, 40 new hazardous chemicals have been added to Annex I of the PIC (Prior Informed Consent) Regulation, including 35 pesticides and 5 other substances used in industrial applications.

This update was introduced by Delegated Regulation (EU) 2024/3199, which came into effect on March 1, 2025.

But first, what is the PIC Regulation?

The PIC Regulation governs the trade of certain hazardous substances that are banned or restricted within the EU and imposes obligations on companies that wish to export these substances to non-EU countries or import them into the EU.

The European Commission updates Annex I annually, listing the chemicals subject to export notification and explicit consent from the importing country. When a chemical is added to Part 1 of Annex I, companies must notify to ECHA before exporting it.

In this specific update, 38 of the 40 newly added substances are included in both Part 1 and Part 2 of Annex I, meaning explicit consent from the importing country is required before the export can proceed.

How does EPY support compliance with the PIC Regulation?

  • When a substance is entered into a user’s archive, the system automatically checks if its identification number is included in the PIC list, while still allowing the user to verify whether the substance belongs to a Chemical Family.
  • After processing, in Section 15.1 of the SDS, EPY can automatically determine the product’s status regarding international import/export conventions and Regulation (EU) No 649/2012, based on the composition of the product.
  • With the “Automatic Update Check” feature enabled, EPY alerts users about necessary updates, including PIC list updates, and applies them to the substances in the user’s archive.
  • The Report Manager provides dedicated reports to highlight whether a substance is subject to the PIC Regulation, allowing companies to continuously monitor the regulatory status of their products.
