Candidate List Update: let’s look at the details

On January 21st, ECHA updated its portal by adding the following substances to the Candidate List:

Besides the newly added substances, the Candidate List update includes a modification of the following entry:

Regarding this last entry, it is worth noting that previously this group of substances was included in the Candidate List due to the presence of 4-nonylphenol, branched and linear, ≥ 0.1% weight/weight as an impurity.
Now, a more specific endocrine-disrupting property for the environment has been recognized for these substances, regardless of the initial presence of 4-nonylphenol in their composition.

Consequences of Inclusion in the Candidate List

1) If supplied as such or in mixtures
Suppliers within the EU and the European Economic Area of substances listed in the “Candidate List,” whether supplied alone or in mixtures, must update the safety data sheet provided to their customers. The presence of these substances must be declared in Section 3 if they are present at 0.1% or more, regardless of their classification.

2) If contained in an article
According to Article 33 of the REACH regulation, if an article contains a substance from the “Candidate List” at a concentration higher than 0.1% (weight/weight), suppliers must provide their customers and consumers with information on how to use it safely. Consumers have the right to ask suppliers whether the products they purchase contain substances listed in the Candidate List.
Importers and producers of articles containing at least 0.1% of a Candidate List substance must notify ECHA if the total amount of the substance in the articles exceeds 1 ton/year.
Under the Waste Framework Directive, companies must also notify ECHA if the articles they produce contain substances of very high concern in concentrations exceeding 0.1% (weight/weight).
